Terms and Conditions
1. Introduction
These Terms and Conditions (hereinafter "Terms") govern the relationship between BMOBIL, a company based in the Czech Republic, and any individual or legal entity (hereinafter "Buyer" or "Customer") who places an order for goods via the website BMOBIL.CZ (hereinafter "Website"). By placing an order, the Buyer unconditionally agrees to these Terms.
2. Definitions
- Goods: Any product or service offered for sale on the Website, including electronic products, mobile accessories, etc.
- Order: An action where the Buyer selects one or more products and confirms the purchase on the Website.
- Contract: The agreement between BMOBIL and the Buyer that is concluded at the moment of order confirmation and payment.
- Seller: The company BMOBIL, operating the Website BMOBIL.CZ and offering goods for sale.
- Customer: Any person who places an order on the Website and accepts these Terms.
3. Acceptance of Terms
By placing an order on the Website, the Buyer unconditionally agrees to these Terms. These Terms may be changed at any time, and the changes will be effective immediately upon their publication on the Website. The Buyer is encouraged to regularly check these Terms.
4. Order
An order is valid when the Buyer:
- Selects the desired goods and adds them to the shopping cart,
- Enters their delivery and billing details,
- Selects the payment method and completes the payment,
- Receives an order confirmation email from BMOBIL.
The contract between the Buyer and BMOBIL is concluded at the moment the Buyer receives the order confirmation via email. BMOBIL reserves the right to refuse or cancel an order if there are issues with payment or provided details.
5. Prices and Payment Methods
- Price of Goods: The prices displayed on the Website are in Czech korunas (CZK), including all taxes (VAT). Delivery costs are calculated separately and added to the total order price before payment confirmation.
- Payment Methods: The Buyer can pay by card (Visa, MasterCard, etc.), bank transfer, or use a payment service like Twisto. Payment is made at the time of placing the order, and the Buyer must ensure that the payment is confirmed before the goods are shipped.
- Invoicing: A detailed invoice will be sent to the Buyer's email address after the payment is completed. The invoice can also be downloaded from their personal account on the Website.
6. Delivery
- Delivery Address: The Buyer must provide the correct and complete delivery address. In the case of an error in the provided address, BMOBIL is not responsible for delays or loss of the order.
- Delivery Methods: BMOBIL offers several delivery options, including standard and express delivery. Delivery costs vary depending on the selected option and delivery address.
- Delivery Time: BMOBIL strives to deliver goods within the specified time frames upon placing the order. However, delivery times are indicative and may be affected by factors beyond BMOBIL's control (delays by carriers, weather conditions, etc.). In case of significant delays, BMOBIL will notify the Buyer by email.
- Responsibility: The risk associated with delivery (loss, theft, damage) passes to the Buyer once the goods are shipped. The Buyer is responsible for checking the condition of the goods upon receipt and notifying BMOBIL of any discrepancies within 48 hours of delivery.
7. Right of Withdrawal and Return of Goods
In accordance with EU regulations and Czech laws, the Buyer has the right to withdraw from the contract within 14 days of receiving the goods. The Buyer may return the goods without giving a reason, provided that the following conditions are met:
- Return of Goods: The goods must be returned in their original condition and packaging, unused and undamaged.
- Return Costs: The Buyer is responsible for the cost of returning the goods unless the goods are defective or the wrong goods were delivered.
- Refund: Upon receiving the returned goods, BMOBIL will issue a refund within 14 days using the same method of payment as the original order. Delivery costs will not be refunded.
8. Warranty on Goods
All goods sold by BMOBIL are covered by the legal warranty for conformity and hidden defects in accordance with Czech law. If a defect is discovered, the Buyer must contact BMOBIL as soon as possible.
- Complaint Procedure: The Buyer must return the defective goods along with the invoice and a description of the defect. BMOBIL reserves the right to verify the nature of the defect and offer either a replacement or a refund.
- Warranty Exceptions: The warranty does not cover damage caused by improper use, inadequate maintenance, or normal wear and tear of the goods.
9. Protection of Personal Data
BMOBIL takes the protection of its customers' personal data very seriously. In accordance with the General Data Protection Regulation (GDPR), BMOBIL collects and processes personal data only for the purpose of processing orders and managing business relationships.
- Purpose of Data Collection: Data is used for order processing, delivery management, customer communication, and fulfilling BMOBIL's legal obligations.
- Buyer’s Rights: The Buyer has the right to access, correct, and delete their personal data by contacting BMOBIL. The Buyer may also object to the use of their data for marketing purposes.
10. Intellectual Property
All materials on the Website, including text, images, logos, graphics, videos, and other content, are protected by copyright and other intellectual property rights. The Buyer agrees not to copy, distribute, or use these materials without prior consent from BMOBIL.
11. Liability
BMOBIL is not liable for any direct or indirect damages resulting from the use of the goods or the inability to use them. BMOBIL's liability is limited to the amount corresponding to the value of the order in case of failure.
12. Applicable Law and Jurisdiction
These Terms are governed by Czech law. In case of disputes, the competent courts in Prague, Czech Republic, shall have exclusive jurisdiction, except for consumer disputes, where consumers may use the jurisdiction of their place of residence.
13. Changes to Terms
BMOBIL reserves the right to modify or update these Terms at any time. Changes will be published on the Website and will take effect immediately upon publication. The Buyer is obliged to regularly review these Terms.
